Riassunto analitico
The aim of this research is verifying whether the TBT Agreement provides a self-standing legal framework to regulate provisions concerning technical barriers to trade in Regional Trade Agreements (RTAs).
In order to do so, first I will look into the relationship between GATT and the TBT Agreement, to uderstand whether they may apply cumulatively or not. This is of crucial importance, as GATT includes an explicit exception for RTAs (Art. XXIV GATT), whereas the TBT Agreement does not.
Then, I will try to identify all the relevant provisions in the TBT Agreement, to see whether the Agreement leaves any lacuna legis concerning the regulation of TBT provisions in RTAs.
Finally and in the light of findings, I will try to explain why I believe that Art. XXIV GATT should not apply to TBT provisions in RTAs and why the TBT Agreement should be applied autonomously.
